American, George Mason Universities Under Investigation Over Antisemitism Claims

‘University leaders must do better,’ Secretary of Education said.

Three DMV-area schools — American University, George Mason University and University of Virginia — are among the 60 universities under investigation by the United States Department of Education’s Office of Civil Rights for alleged failures to address campus antisemitism, according to a DOE press release.

The 60 universities under investigation were identified due to “student and faculty complaints alleging antisemitic harassment tied to recent protests and campus unrest, failure to adequately protect Jewish students from discrimination and hostile environments and concerns that university policies or disciplinary actions have allowed or even encouraged antisemitic conduct,” according to paulhastings.com.

In one of the largest civil rights investigations into higher education in U.S. history, OCR sent letters to 60 universities on Monday warning them of “potential enforcement actions” if they do not uphold their obligations under Title VI of the Civil Rights Act by protecting Jewish students on campus.

The potential consequences include loss of federal funding, compliance mandates and legal action if universities are found to fail in their obligations under Title VI, which prohibits discrimination on the basis of race, color or national origin in federally funded programs.

“The Department is deeply disappointed that Jewish students studying on elite U.S. campuses continue to fear for their safety amid the relentless antisemitic eruptions that have severely disrupted campus life for more than a year,” Secretary of Education Linda McMahon said in the press release. “University leaders must do better.”

This series of investigations will look at whether universities have responded appropriately to reports of harassment or intimidation, upheld policies that permit free speech “without allowing discriminatory behavior” and instated effective ways to “prevent and address antisemitism on campus.”

The DOE’s actions are the latest in a federal crackdown on universities. On Feb. 3, under President Donald Trump’s executive order Additional Measures to Combat Anti-Semitism, the department announced investigations into five institutions of higher education where “widespread antisemitic harassment” has been reported, according to the DOE press release.

These schools are Columbia University; Northwestern University; Portland State University; The University of California, Berkeley; and The University of Minnesota, Twin Cities.
